Sehr geehrte Ärztinnen und Ärzte,
wichtige Nachricht, die im Ausland wie eine kleine Bombe einschlug und wie so oft nicht
einmal von der luxemburgischen Presse aufgegriffen wurde1.
bestätigte der österreichische Gesundheitsminister Johannes Rauch, dass Ärzte, die
Impfstoffe gegen COVID-19 verabreichen, verpflichtet sind, ihre Patienten rechtzeitig über
die Vorteile und Risiken der experimentellen Behandlung zu informieren.
Die Nichteinhaltung ihrer Informationspflicht könne sogar mit Geldstrafen belegt werden, die
im Wiederholungsfall bis zu 14.000 Euro betragen könnten2.
Ausführungen des Psychologen Roland Kolber (“Eine informierte Einwilligung ist seit jeher
für jede medizinische Handlung erforderlich.”) und des Rechtsanwalts Christian Bock (“Eine
informierte Einwilligung, die vom Patienten unterzeichnet wird, entzieht der Behandlung
ihren strafrechtlichen Charakter. Eine Injektion ohne informierte Zustimmung wird einer
Körperverletzung gleichgestellt und ist somit strafbar.”) bei unserem 2. Runden Tisch am 11.
März 20223.
Zusammenhang mit COVID-Impfungen zu klären und mithilfe eines Formulars zur
Einwilligung nach Aufklärung und zur zivil- und strafrechtlichen Haftung transparent zu
machen, damit sowohl der Patient als auch der Arzt über die Folgen ihres Handelns
informiert sind.

En date du 22 juin 2022, le magazine en ligne autrichien “Wochenblick” a publié une
information capitale qui a eu l’effet d’une petite bombe à l’étranger, or comme si souvent,
celle-ci n’a même pas été relayée par la presse luxembourgeoise1.
En répondant à une question parlementaire émanant du député FPÖ Gerald Hauser, le
ministre de la Santé autrichien Johannes Rauch a confirmé que les médecins administrant
les vaccins contre la COVID-19 étaient dans l’obligation de renseigner leurs patients
suffisamment à l’avance sur les avantages et les risques du traitement expérimental.
Le fait de faillir à leur devoir d’information pourrait même être synonyme d’amendes
susceptibles d’atteindre les 14.000 euros en cas de récidive2.
Les précisions apportées par le ministre de la Santé autrichien sont en accord avec les
propos du psychologue Roland Kolber (« Un consentement éclairé est nécessaire depuis
toujours, pour tout acte médical.») et de Maître Christian Bock (« Un consentement éclairé,
signé par le patient, retire au traitement son caractère pénal. Une injection sans
consentement éclairé est assimilée à un acte de coup et blessure et est donc punissable. »)
lors de notre 2e Table Ronde du 11 mars 20223.
Nous demandons donc au gouvernement luxembourgeois de clarifier les questions de
responsabilité en ce qui concerne les vaccinations COVID et de les rendre transparentes à
l’aide d’un formulaire de consentement éclairé et de responsabilité civile et pénale, afin que
le patient et le médecin soient tous deux informés des conséquences de leurs actes.

On 22 June 2022, the Austrian online magazine “Wochenblick” published a major piece of
information which had the effect of a small bomb abroad, but as so often, it was not even
reported by the Luxembourgish press1.
Answering a parliamentary question from FPÖ MP Gerald Hauser, Austrian Health Minister
Johannes Rauch confirmed that doctors administering COVID-19 vaccines were obliged to
inform their patients sufficiently in advance about the benefits and risks of the experimental
treatment. Failure to do so could even result in fines of up to 14,000 euros for repeat
offences2.
The Austrian Health Minister’s clarification is in line with the words of psychologist Roland
Kolber (“Informed consent has always been necessary for any medical act.”) and lawyer
Christian Bock (“Informed consent, signed by the patient, removes the criminal nature of the
treatment. An injection without informed consent is assimilated to an act of assault and
battery and is therefore punishable.”) at our 2nd Round Table on 11 March 20223.
We therefore call on the Luxembourgish government to clarify the liability issues regarding
COVID vaccinations and to make them transparent by means of an informed consent and
civil and criminal liability form, so that both the patient and the doctor are informed of the
consequences of their actions.
