Am 22. Juni 2022 ver\u00f6ffentlichte das \u00f6sterreichische Online-Magazin „Wochenblick“ eine
wichtige Nachricht, die im Ausland wie eine kleine Bombe einschlug und wie so oft nicht
einmal von der luxemburgischen Presse aufgegriffen wurde1.<\/div>
\u00a0<\/div>
In seiner Antwort auf eine parlamentarische Anfrage des FP\u00d6-Abgeordneten Gerald Hauser
best\u00e4tigte der \u00f6sterreichische Gesundheitsminister Johannes Rauch, dass \u00c4rzte, die
Impfstoffe gegen COVID-19 verabreichen, verpflichtet sind, ihre Patienten rechtzeitig \u00fcber
die Vorteile und Risiken der experimentellen Behandlung zu informieren.
Die Nichteinhaltung ihrer Informationspflicht k\u00f6nne sogar mit Geldstrafen belegt werden, die
im Wiederholungsfall bis zu 14.000 Euro betragen k\u00f6nnten2.<\/div>
\u00a0<\/div>
Die Klarstellungen des \u00f6sterreichischen Gesundheitsministers stimmen mit den
Ausf\u00fchrungen des Psychologen Roland Kolber („Eine informierte Einwilligung ist seit jeher
f\u00fcr jede medizinische Handlung erforderlich.“) und des Rechtsanwalts Christian Bock („Eine
informierte Einwilligung, die vom Patienten unterzeichnet wird, entzieht der Behandlung
ihren strafrechtlichen Charakter. Eine Injektion ohne informierte Zustimmung wird einer
K\u00f6rperverletzung gleichgestellt und ist somit strafbar.“) bei unserem 2. Runden Tisch am 11.
M\u00e4rz 20223.<\/div>

Wir fordern daher die luxemburgische Regierung auf, die Haftungsfragen im
Zusammenhang mit COVID-Impfungen zu kl\u00e4ren und mithilfe eines Formulars zur
Einwilligung nach Aufkl\u00e4rung und zur zivil- und strafrechtlichen Haftung transparent zu
machen, damit sowohl der Patient als auch der Arzt \u00fcber die Folgen ihres Handelns
informiert sind.<\/div>

En date du 22 juin 2022, le magazine en ligne autrichien \u201cWochenblick\u201d a publi\u00e9 une
information capitale qui a eu l’effet d\u2019une petite bombe \u00e0 l\u2019\u00e9tranger, or comme si souvent,
celle-ci n\u2019a m\u00eame pas \u00e9t\u00e9 relay\u00e9e par la presse luxembourgeoise1.<\/p>

En r\u00e9pondant \u00e0 une question parlementaire \u00e9manant du d\u00e9put\u00e9 FP\u00d6 Gerald Hauser, le
ministre de la Sant\u00e9 autrichien Johannes Rauch a confirm\u00e9 que les m\u00e9decins administrant
les vaccins contre la COVID-19 \u00e9taient dans l’obligation de renseigner leurs patients
suffisamment \u00e0 l’avance sur les avantages et les risques du traitement exp\u00e9rimental.
Le fait de faillir \u00e0 leur devoir d\u2019information pourrait m\u00eame \u00eatre synonyme d\u2019amendes
susceptibles d’atteindre les 14.000 euros en cas de r\u00e9cidive2.<\/p>

Les pr\u00e9cisions apport\u00e9es par le ministre de la Sant\u00e9 autrichien sont en accord avec les
propos du psychologue Roland Kolber (\u00ab Un consentement \u00e9clair\u00e9 est n\u00e9cessaire depuis
toujours, pour tout acte m\u00e9dical.\u00bb) et de Ma\u00eetre Christian Bock (\u00ab Un consentement \u00e9clair\u00e9,
sign\u00e9 par le patient, retire au traitement son caract\u00e8re p\u00e9nal. Une injection sans
consentement \u00e9clair\u00e9 est assimil\u00e9e \u00e0 un acte de coup et blessure et est donc punissable. \u00bb)
lors de notre 2e Table Ronde du 11 mars 20223.<\/p>

Nous demandons donc au gouvernement luxembourgeois de clarifier les questions de
responsabilit\u00e9 en ce qui concerne les vaccinations COVID et de les rendre transparentes \u00e0
l’aide d’un formulaire de consentement \u00e9clair\u00e9 et de responsabilit\u00e9 civile et p\u00e9nale, afin que
le patient et le m\u00e9decin soient tous deux inform\u00e9s des cons\u00e9quences de leurs actes.<\/p>

Dear doctors,<\/p>

On 22 June 2022, the Austrian online magazine „Wochenblick“ published a major piece of
information which had the effect of a small bomb abroad, but as so often, it was not even
reported by the Luxembourgish press1.<\/p>

Answering a parliamentary question from FP\u00d6 MP Gerald Hauser, Austrian Health Minister
Johannes Rauch confirmed that doctors administering COVID-19 vaccines were obliged to
inform their patients sufficiently in advance about the benefits and risks of the experimental
treatment. Failure to do so could even result in fines of up to 14,000 euros for repeat
offences2.<\/p>

The Austrian Health Minister’s clarification is in line with the words of psychologist Roland
Kolber („Informed consent has always been necessary for any medical act.“) and lawyer
Christian Bock („Informed consent, signed by the patient, removes the criminal nature of the
treatment. An injection without informed consent is assimilated to an act of assault and
battery and is therefore punishable.“) at our 2nd Round Table on 11 March 20223.<\/p>

We therefore call on the Luxembourgish government to clarify the liability issues regarding
COVID vaccinations and to make them transparent by means of an informed consent and
civil and criminal liability form, so that both the patient and the doctor are informed of the
consequences of their actions.<\/p>
