Die WHO (Weltgesundheitsorganisation), als Sonderorganisation der Vereinten Nationen (UNO), hat
als Ziel die Koordination des internationalen Gesundheitswesens. Sie wurde 1948 gegr\u00fcndet und
z\u00e4hlt heute 194 Mitgliedsstaaten, darunter auch Luxemburg. Sie ist hervorgegangen aus den
Bestrebungen, Seuchen zu verhindern oder einzud\u00e4mmen.1 Seit Beginn des 19. Jahrhunderts gab es
eine Reihe von Konferenzen und Konventionen zu diesem Zweck. Stets hatten die Menschen Angst
vor \u201eInfektionskrankheiten\u201c und Seuchen wie der Pest oder Cholera und wollten sich sch\u00fctzen, auch
im Hinblick, den internationalen Handel nicht zu gef\u00e4hrden.<\/p>\n

Aktuelle Leitlinien seitens der WHO gibt es z.B. im Regelungswerk der Internationalen
Gesundheitsvorschriften (International Health Regulations, R\u00e8glement Sanitaire International)2. Die
heute g\u00fcltigen Vorschriften wurden auf der 58. Weltgesundheitsversammlung am 23. Mai 2005
angenommen und traten f\u00fcr alle Vertragsstaaten am 15. Juni in Kraft. Seit dem 15. Juni 2007 sind sie
v\u00f6lkerrechtlich verbindlich.<\/p>\n

Das RKI schreibt dazu:
\u201eDie IGV bilden das v\u00f6lkerrechtliche Fundament der internationalen Bek\u00e4mpfung von Infektionskrankheiten.\u201c \u2026 \u201eDer
Anwendungsbereich der Vereinbarungen wurde deutlich erweitert: f\u00fcr die WHO bestehen mehr M\u00f6glichkeiten der
Einflussnahme und es werden Vorgaben hinsichtlich der Surveillance und Kontrolle von Ereignissen von internationaler
Tragweite gemacht, die von den Mitgliedstaaten umzusetzen sind. Die IGV (2005) sind auf s\u00e4mtliche Ereignisse
anwendbar (nat\u00fcrlich oder beabsichtigt), die eine Gefahr f\u00fcr die \u00f6ffentliche Gesundheit darstellen k\u00f6nnen (biologisch,
chemisch oder durch ionisierende Strahlen).\u201c 3<\/p>\n

Wie aus dieser Beschreibung hervorgeht, wurde die Einflussbereich der WHO st\u00e4ndig ausgeweitet.
Jetzt sollen diese noch einmal abge\u00e4ndert werden, wobei das Mitsprache- und Entscheidungsrecht
der einzelnen Staaten weiter eingeschr\u00e4nkt werden sollen und die Verfassungen ausgehebelt werden
k\u00f6nnen;4 sicher erw\u00e4hnenswert im Kontext mit der aktuellen Verfassungsreform.<\/p>\n

Dies ist vorgesehen auf der 75. Generalsversammlung der WHO vom 22. bis zum 28. Mai 2022<\/b>.5
Vorschl\u00e4ge dazu finden wir im offiziellen Text vom 12. April 2022.6 James Roguski, Forscher und Autor
im Bereich Gesundheit, macht auf die Artikel 12 und 59 aufmerksam, die wesentlich sind im Kontext
der Selbstbestimmung der Staaten.7 In Artikel 12 wird ein PHERC<\/b> (Public Health Emergency of
regional concern) vorgesehen (w\u00fcrde hei\u00dfen: lokale B\u00fcrokraten bekommen noch mehr Macht) oder
die M\u00f6glichkeit f\u00fcr den Generaldirektor der WHO geschaffen, eine IPHA <\/b>(intermediate public health
alert) auszurufen. Die M\u00f6glichkeiten, eine Region vom Rest der Welt abzusondern und damit
Menschen ihrer Freiheiten zu berauben, aufgrund willk\u00fcrlicher Entscheidungen, basierend auf
Angstmacherei, sollen demnach erweitert werden.<\/p>\n

Parallel hat die WHO eine Arbeitsgruppe ins Leben gerufen um einen neuen Pandemievertrag
auszuarbeiten. Dieser soll 2024 in Kraft treten.8<\/p>\n

Wir m\u00f6chten unsere Besorgnis \u00fcber diese Entwicklungen, hin zu einer quasi Weltregierung mittels
der WHO zum Ausdruck bringen.9 Die Bef\u00fcrchtungen werden weltweit geteilt und sind berechtigt.10<\/p>\n

Bis jetzt machte die WHO Gebrauch vom PHEIC (Public Health Emergency of International Concern)
beim Ausrufen von Pandemien. Ebenso geschehen f\u00fcr die \u201eCorona-Pandemie\u201c am 30. Januar 2020,
was die Luxemburger Regierung dazu veranlasste, am 18. M\u00e4rz 2020 den Ausnahmezustand
auszurufen und nachfolgend eine Reihe von Ma\u00dfnahmen mit den Covid-19 Gesetzen ab 17. Juli 2020
zu verh\u00e4ngen, dies mit schwerwiegenden Folgen f\u00fcr die physische und psychische Gesundheit, die
Wirtschaft, sowie das gesellschaftliche Leben; ohne selbst zu \u00fcberpr\u00fcfen, ob dieser Notstand seitens
der WHO durch wissenschaftliche Fakten belegt sei. Zumindest im Nachhinein sollte hier eine seri\u00f6se
Aufarbeitung stattfinden. Zum Beispiel gab es einen sog. PHEIC seitens der WHO betreffend
\u201eEbolavirus\u201c 11, was seinerzeit und bis heute aber kaum Auswirkungen auf die Gesundheitspolitik
Luxemburgs hatte.<\/p>\n

Neben James Roguski haben sich noch 2 weitere Kenner der WHO kritisch mit ihr auseinandergesetzt
und verfolgen die aktuellen Entwicklungen: die Wissenschaftlerin und Forscherin im
Gesundheitsbereich Astrid Stuckelberger12 und die Juristin Silvia Behrendt. Letztere wies k\u00fcrzlich auf
juristische Unklarheiten hin betreffend der Verbindlichkeit der IHR nach dem V\u00f6lkerrecht.13 Sie hat
ihre eigene Plattform zu diesen Themen erstellt.14<\/p>\n

Zust\u00e4ndig f\u00fcr Luxemburg ist die \u201eDivision de l\u2019inspection sanitaire\u201c, wie es in einem Gesetz von 2015
hei\u00dft.15<\/p>\n

Art.4 (1) La division de l\u2019inspection sanitaire est charg\u00e9e:
– d\u2019assurer la protection de la sant\u00e9 publique tant en ce qui concerne l\u2019hygi\u00e8ne du milieu que la surveillance et la lutte
contre les maladies transmissibles;
– d\u2019organiser le contr\u00f4le m\u00e9dical des ressortissants de pays tiers;
– de traiter les dossiers relatifs aux \u00e9trangers souhaitant se faire soigner au Luxembourg et dont la prise en charge n\u2019est pas
assur\u00e9e par les organismes de s\u00e9curit\u00e9 sociale;
– de se prononcer sur l\u2019aptitude m\u00e9dicale \u00e0 des mesures d\u2019\u00e9loignement.
Elle remplit en outre la mission de point focal national dans le cadre du R\u00e8glement sanitaire international.<\/p>\n

Unsere Vertreter bei den 2 letzten WHA, im Mai 2020 und 2021, sind in Endnote 16 zu finden.
Die Vertreter der 150. Versammlung des \u201eexecutive boards\u201c am 29. Januar 2022 sind in Endnote 17

Fragen, die sich stellen:
– Wer wird Luxemburg dieses Mal vertreten?
– Ist ein Luxemburger Vertreter Mitglied im Vorstand (executive board) nach den Artikeln 24-29 im
Kapitel VI der Verfassung der WHO?18
– Hatte die Regierung rechtzeitig Einsicht in die \u00c4nderungsvorschl\u00e4ge?
– Gab es im Vorfeld Kritik seitens der Luxemburger Regierung an den \u00c4nderungsvorschl\u00e4gen?
– Ist sich die Regierung bewusst, dass durch diese \u00c4nderungen, wenn sie ohne Widerspruch nach 6
Monaten in Kraft treten sollen, die Souver\u00e4nit\u00e4t des Landes weiter untergraben werden kann?
– Sieht die Regierung eine \u00f6ffentliche Debatte zu diesem Thema vor?
– In welchem Gesetz sind die \u201eInternational Health Regulations\u201c von 2005 verankert, falls sie von
Luxemburg ratifiziert worden sind?<\/p>\n

Wir sind der Auffassung, dass Luxemburg die Mitgliedschaft bei der WHO \u00fcberdenken sollte, da sie
die Interessen der Luxemburger (wie allen anderen Mitgliedsstaaten) zu stark untergr\u00e4bt, ganz
abgesehen von den hohen j\u00e4hrlichen Zahlungen an die WHO.<\/p>\n

Kritikpunkte<\/b> an der WHO gibt es gen\u00fcgend:
– keine demokratisch legitimierte Institution
– keine Neutralit\u00e4t
– Interessenkonflikte; zu insgesamt etwa 80 % privat- und pharmafinanziert
– Direktor Tedros Gebreyesus, vorbelastet durch schwere Vorw\u00fcrfe gegen ihn als fr\u00fcheren
Gesundheitsminister in \u00c4thiopien und seine Beziehungen zur Tigray-Befreiungsfront (TPLF)
– keine unabh\u00e4ngige \u00dcberpr\u00fcfung
– einseitige Sicht auf Krankheit mit Schwerpunkt Impfungen
– \u00fcberzogene Panikmache (Beispiel: sog. Schweinegrippe 2009)
– \u201eWissenschaft\u201c, die auf Konsens beruht<\/p>\n

Mit den Bestrebungen, noch mehr Macht in ihren H\u00e4nden zu vereinigen, entsteht eine gef\u00e4hrliche
Entwicklung in Bezug auf den Verlust der Freiheiten der Menschen.<\/p>\n

Wir erkennen den Sinn einer internationalen Zusammenarbeit bei Gesundheitsfragen an, dies aber
immer unter Ber\u00fccksichtigung und Respektierung der landeseigenen Verfassungen und Gesetze, die
durch eine faktische Macht\u00fcbernahme der WHO aber ganz offensichtlich zur Disposition st\u00fcnden.<\/p>\n

L’OMS (Organisation mondiale de la sant\u00e9), en tant qu’agence sp\u00e9cialis\u00e9e des Nations Unies
(ONU), a pour objectif de coordonner la sant\u00e9 publique internationale. Elle a \u00e9t\u00e9 fond\u00e9e en
1948 et compte aujourd’hui 194 \u00c9tats membres, dont le Luxembourg. Elle est n\u00e9e de la
volont\u00e9 de pr\u00e9venir ou d’endiguer les \u00e9pid\u00e9mies.1 Depuis le d\u00e9but du 19e si\u00e8cle, une s\u00e9rie
de conf\u00e9rences et de conventions ont \u00e9t\u00e9 organis\u00e9es dans ce but. Les gens ont toujours eu
peur des „maladies infectieuses“ ainsi que des \u00e9pid\u00e9mies comme la peste ou le chol\u00e9ra et
ont voulu se prot\u00e9ger, notamment pour ne pas mettre en danger le commerce international.<\/p>

Les directives actuelles de l’OMS se trouvent par exemple dans le R\u00e8glement sanitaire
international (RSI) 2. Le r\u00e8glement actuel a \u00e9t\u00e9 adopt\u00e9 lors de la 58e Assembl\u00e9e mondiale de
la sant\u00e9 le 23 mai 2005 et est entr\u00e9 en vigueur pour tous les \u00c9tats parties le 15 juin 2007.<\/p>

Le RKI \u00e9crit \u00e0 ce sujet :
„Les RSI constituent le fondement juridique international de la lutte internationale contre les
maladies infectieuses“. … „Le champ d’application des accords a \u00e9t\u00e9 consid\u00e9rablement \u00e9largi
: l’OMS a davantage de possibilit\u00e9s d’exercer une influence et des directives sont donn\u00e9es
concernant la surveillance et le contr\u00f4le des \u00e9v\u00e9nements de port\u00e9e internationale, qui
doivent \u00eatre mises en \u0153uvre par les \u00c9tats membres. Le RSI (2005) s’applique \u00e0 tous les
\u00e9v\u00e9nements (naturels ou intentionnels) susceptibles de pr\u00e9senter un risque pour la sant\u00e9
publique (biologiques, chimiques ou dus \u00e0 des radiations ionisantes)“. 3<\/p>

Comme il ressort de cette description, la sph\u00e8re d’influence de l’OMS n’a cess\u00e9 de s’\u00e9tendre.
Aujourd’hui, il est pr\u00e9vu de modifier les directives une fois de plus, en limitant encore
davantage le droit de parole et de d\u00e9cision des diff\u00e9rents \u00c9tats et en permettant de
neutraliser les constitutions ; 4ce qui m\u00e9rite certainement d’\u00eatre mentionn\u00e9 dans le contexte
de la r\u00e9forme constitutionnelle actuelle.<\/p>

Cela est pr\u00e9vu lors de la 75e Assembl\u00e9e g\u00e9n\u00e9rale de l’OMS du 22 au 28 mai 2022<\/b>. 5Nous
trouvons des propositions \u00e0 ce sujet dans le texte officiel du 12 avril 2022. 6 James Roguski,
chercheur et auteur dans le domaine de la sant\u00e9, attire l’attention sur les articles 12 et 59,
qui sont essentiels dans le contexte de l’autod\u00e9termination des \u00c9tats. 7 L’article 12 pr\u00e9voit un
PHERC <\/b>(Public Health Emergency of regional concern- Urgence de sant\u00e9 publique de port\u00e9e
internationale) (ce qui signifie que les bureaucrates locaux auront encore plus de pouvoir) ou
la possibilit\u00e9 pour le directeur g\u00e9n\u00e9ral de l’OMS de d\u00e9clarer une IPHA <\/b>(intermediate public
health alert – alerte sanitaire interm\u00e9diaire). Les possibilit\u00e9s d’isoler une r\u00e9gion du reste du
monde et de priver ainsi les gens de leurs libert\u00e9s, sur la base de d\u00e9cisions arbitraires bas\u00e9es
sur la peur, seront donc \u00e9largies.<\/p>

Parall\u00e8lement, l’OMS a mis en place un groupe de travail pour \u00e9laborer un nouveau trait\u00e9
sur les pand\u00e9mies<\/b>. Celui-ci devrait entrer en vigueur en 2024. 8<\/p>

Nous souhaitons exprimer notre inqui\u00e9tude face \u00e0 cette \u00e9volution vers une quasi-
gouvernance mondiale par le biais de l’OMS. 9 Les craintes sont partag\u00e9es dans le monde
entier et justifi\u00e9es. 10<\/p>

Jusqu’\u00e0 pr\u00e9sent, l’OMS a utilis\u00e9 le PHEIC (Public Health Emergency of International Concern)
pour d\u00e9clarer des pand\u00e9mies. C’est ce qui s’est pass\u00e9 pour la „pand\u00e9mie Corona“ le 30
janvier 2020, ce qui a conduit le gouvernement luxembourgeois \u00e0 d\u00e9clarer l’\u00e9tat d’urgence le
18 mars 2020 et \u00e0 imposer ensuite une s\u00e9rie de mesures avec les lois Covid-19 \u00e0 partir du 17
juillet 2020, avec de graves cons\u00e9quences pour la sant\u00e9 physique et psychique, l’\u00e9conomie et
la vie sociale ; sans v\u00e9rifier lui-m\u00eame si cet \u00e9tat d’urgence de la part de l’OMS \u00e9tait \u00e9tay\u00e9 par
des faits scientifiques. Une analyse s\u00e9rieuse devrait au moins avoir lieu a posteriori. Par
exemple, il y a eu un soi-disant PHEIC de la part de l’OMS concernant le „virus Ebola“11, mais
cela n’a gu\u00e8re eu d’impact sur la politique de sant\u00e9 du Luxembourg \u00e0 l’\u00e9poque et jusqu’\u00e0
aujourd’hui.<\/p>

Outre James Roguski, deux autres experts de l’OMS se sont pench\u00e9s de mani\u00e8re critique sur
l’organisation et suivent les d\u00e9veloppements actuels : la scientifique et chercheuse dans le
domaine de la sant\u00e9 Astrid Stuckelberger12 et la juriste Silvia Behrendt. Cette derni\u00e8re a
r\u00e9cemment soulign\u00e9 les ambigu\u00eft\u00e9s juridiques concernant la nature contraignante du RSI en
vertu du droit international. 13 Elle a cr\u00e9\u00e9 sa propre plate-forme sur ces questions.<\/p>

Selon une loi de 2015, la “ Division de l’inspection sanitaire “ est en charge du Luxembourg. 15
Art.4 (1) La division de l\u2019inspection sanitaire est charg\u00e9e:
– d\u2019assurer la protection de la sant\u00e9 publique tant en ce qui concerne l\u2019hygi\u00e8ne du milieu que la surveillance et la
lutte contre les maladies transmissibles;
– d\u2019organiser le contr\u00f4le m\u00e9dical des ressortissants de pays tiers;
– de traiter les dossiers relatifs aux \u00e9trangers souhaitant se faire soigner au Luxembourg et dont la prise en charge
n\u2019est pas assur\u00e9e par les organismes de s\u00e9curit\u00e9 sociale;
– de se prononcer sur l\u2019aptitude m\u00e9dicale \u00e0 des mesures d\u2019\u00e9loignement.
Elle remplit en outre la mission de point focal national dans le cadre du R\u00e8glement sanitaire international.<\/b><\/p>

Les questions qui se posent :
– Qui repr\u00e9sentera le Luxembourg cette fois-ci ?

– Un repr\u00e9sentant luxembourgeois est-il membre du conseil d’administration (executive
board) conform\u00e9ment aux articles 24-29 du chapitre VI de la Constitution de l’OMS ? 18
– Le gouvernement a-t-il pu prendre connaissance \u00e0 temps des propositions de modification?
– Le gouvernement luxembourgeois a-t-il \u00e9mis des critiques pr\u00e9alables \u00e0 l’\u00e9gard des
propositions de modification ?
– Le gouvernement est-il conscient du fait que ces modifications, si elles doivent entrer en
vigueur au bout de 6 mois sans opposition, risquent de saper davantage la souverainet\u00e9 du
pays ?
– Le gouvernement pr\u00e9voit-il un d\u00e9bat public sur ce sujet ?
– Dans quelle loi sont inscrits les „International Health Regulations“ de 2005, s’ils ont \u00e9t\u00e9
ratifi\u00e9s par le Luxembourg ?<\/p>

Nous sommes d’avis que le Luxembourg devrait reconsid\u00e9rer son adh\u00e9sion \u00e0 l’OMS, car elle
sape trop fortement les int\u00e9r\u00eats des Luxembourgeois (comme de tous les autres \u00c9tats
membres), sans parler des paiements annuels \u00e9lev\u00e9s \u00e0 l’OMS.<\/p>

Les critiques<\/b> \u00e0 l’encontre de l’OMS ne manquent pas :
– pas d’institution d\u00e9mocratiquement l\u00e9gitim\u00e9e
– pas de neutralit\u00e9
– conflits d’int\u00e9r\u00eats ; financ\u00e9e \u00e0 environ 80 % par le secteur priv\u00e9 et pharmaceutique.
– le directeur Tedros Gebreyesus, dont la r\u00e9putation est entach\u00e9e par les graves accusations
port\u00e9es contre lui en tant qu’ancien ministre de la sant\u00e9 en \u00c9thiopie et ses relations avec le
Front de lib\u00e9ration du Tigr\u00e9 (TPLF)- pas de v\u00e9rification ind\u00e9pendante
– vision unilat\u00e9rale de la maladie mettant l’accent sur la vaccination

The WHO (World Health Organisation), as a specialised agency of the United Nations (UN),
aims to coordinate international health care. It was founded in 1948 and today has 194
member states, including Luxembourg. It emerged from efforts to prevent or contain
epidemics.1 Since the beginning of the 19th century, there have been a number of
conferences and conventions for this purpose. People have always been afraid of „infectious
diseases“ and epidemics such as the plague or cholera and wanted to protect themselves,
also with a view to not endangering international trade.<\/p>\n

Current guidelines from the WHO can be found, for example, in the International Health
Regulations (R\u00e8glement Sanitaire International)2. The currently valid regulations were
adopted at the 58th World Health Assembly on 23 May 2005 and came into force for all
signatory states on 15 June. They have been binding under international law since 15 June
2007.<\/p>\n

The RKI writes on this:
„The IHR form the foundation of international law for the fight against infectious diseases.“
… „The application scope of the agreements has been significantly expanded: there are
more possibilities for the WHO to exert influence and specifications are made with regard to
the surveillance and control of events of international significance, which are to be
implemented by the Member States. The IHR (2005) are applicable to all events (natural or
intentional) that may pose a risk to public health (biological, chemical or ionising
radiation).“3
<\/p>\n

As can be seen from this description, the WHO’s sphere of influence has been steadily
expanding. Now these are to be amended yet again, with the right of individual states to
have a say and make decisions to be further restricted and constitutions to be undermined;4
certainly worth mentioning in the context of the current constitutional reform.
<\/p>\n

This is foreseen at the 75th General Assembly of the WHO from 22 to 28 May 2022<\/b>.5
Proposals for this can be found in the official text of 12 April 2022.6 James Roguski,
researcher and author in the field of health, draws attention to Articles 12 and 59, which are
essential in the context of self-determination of states.7 Article 12 provides for a PHERC<\/b>
(Public Health Emergency of regional concern) (meaning local bureaucrats getting even
more power) or the possibility for the WHO Director-General to declare an IPHA<\/b>
(intermediate public health alert). The possibilities of segregating a region from the rest of
the world and thus depriving people of their freedoms due to arbitrary decisions based on
fear-mongering are thus to be expanded.
<\/p>\n

At the same time, the WHO has set up a working group to draft a new pandemic treaty. This
should come into force in 2024.8
<\/p>\n

We would like to express our concern about these developments towards a quasi world
government through the WHO.9 The fears are shared worldwide and are justified.10
<\/p>\n

Until now, the WHO has used the PHEIC (Public Health Emergency of International Concern)
to declare pandemics. The same happened for the „Corona pandemic“ on 30 January 2020,
which led the Luxembourg government to declare a state of emergency on 18 March 2020
and to subsequently impose a series of measures with the Covid-19 laws from 17 July 2020,
with serious consequences for physical and mental health, the economy, as well as social
life; without even checking whether this state of emergency on the part of the WHO was
supported by scientific facts. At least in retrospect, a serious reappraisal should take place
here. For example, there was a so-called PHEIC on the part of the WHO concerning the
„Ebola virus“11, which at the time and to this day has hardly had any effect on Luxembourg’s
health policy.
<\/p>\n

In addition to James Roguski, two other experts have critically examined the WHO and are
following current developments: the scientist and health researcher Astrid Stuckelberger12
and the lawyer Silvia Behrendt. The latter recently pointed out legal ambiguities regarding
the binding nature of the IHR under international law.13 She has created her own platform
on these issues.14
<\/p>\n

According to a law from 2015, the „Division de l’inspection sanitaire“ is in charge of
Luxembourg.15
<\/p>\n

Art.4 (1) The division de l’inspection sanitaire is in charge of:
– ensuring the protection of public health, both with regard to the hygiene of the
environment and to surveillance and the fight against transmissible diseases;
– organising medical checks on residents of other countries;
– dealing with the dossiers relating to foreign nationals who wish to be treated in
Luxembourg and who are not covered by the social security institutions;
– commenting on the medical aptitude for the measures of rehabilitation.
It also acts as the national focal point for the International Health Regulations.<\/b>
<\/p>\n

Questions to ask:
– Who will represent Luxembourg this time?
– Is a Luxembourg representative a member of the executive board according to articles 24-
29 in Chapter VI of the WHO Constitution?18
– Did the government have timely access to the proposed amendments?
– Was there any criticism of the proposed amendments from the Luxembourg government
in advance?
– Is the government aware that these amendments, if they are to come into force without
opposition after 6 months, may further undermine the sovereignty of the country?
– Does the government foresee a public debate on this issue?
– In which law are the „International Health Regulations“ of 2005 enshrined, if they have
been ratified by Luxembourg?
<\/p>\n

We believe that Luxembourg should reconsider its WHO membership as it undermines the
interests of Luxembourgers (like all other member states) too much, not to mention the
high annual payments to the WHO.
<\/p>\n

There are enough points of criticism against the WHO:
– no democratically legitimised institution
– no neutrality
– conflicts of interest; about 80 % privately and pharmaceutically financed.
– director Tedros Gebreyesus, tainted by serious accusations against him as former health
minister in Ethiopia and his relations with the Tigray Liberation Front (TPLF)
– no independent review
– one-sided view of disease with emphasis on vaccination
– exaggerated scaremongering (example: so-called swine flu 2009)
– „science“ based on consensus
<\/p>\n

With efforts to consolidate even more power in their hands, a dangerous development is
emerging in terms of loss of people’s freedoms.
<\/p>\n

We recognise the purpose of international cooperation on health issues, but always with
consideration and respect for national constitutions and laws, which would obviously be at
stake if the WHO were to take over power.

A OMS (Organiza\u00e7\u00e3o mundial da sa\u00fade), como ag\u00eancia especializada nas Na\u00e7\u00f5es Unidas
(ONU), tem como objetivo de coordenar a sa\u00fade publica internacional. Esta mesma foi fundada
em 1948 e conta hoje com 194 Estados membros, incluindo o Luxemburgo. Esta organiza\u00e7\u00e3o
foi criada com o intuito de prevenir ou de conter epidemias. 1. Desde o inicio de s\u00e9culo 19, uma
s\u00e9rie de conferencias e de conven\u00e7\u00f5es foram organizadas com este intuito. A comunidade
sempre teve medo das \u201cdoen\u00e7as contagiosas\u201d tal como das epidemias como a peste ou a c\u00f3lera
e quiseram se proteger, em particular para n\u00e3o meter o mercado internacional em perigo.<\/p>

As diretivas atuais da OMS encontram-se por exemplo no regulamento sanit\u00e1rio internacional
(RSI). 2. O regulamento atual foi adotado ap\u00f3s a 58\u00aa assembleia mundial da sa\u00fade a 23 de maio
de 2005 e entrou em vigor para todos os Estados a 15 de junho de 2007.<\/p>

O RKI escreve a este sujeito:
\u201cOs RSI constituem o fundamento jur\u00eddico internacional da luta internacional contra as doen\u00e7as
contagiosas\u201d. \u2026 \u201c o campo de aplica\u00e7\u00e3o dos acordos foi consideravelmente alargado: a OMS
possui possibilidades de exercer com influencia e s\u00e3o dadas diretivas para a vigil\u00e2ncia e o
controle dos eventos de alcance internacional, que t\u00eam de ser aplicados pelos Estados membros.
O RSI (2005) aplica-se a todos os eventos (naturais ou intencionais) suscet\u00edveis de apresentar
um risco para a sa\u00fade publica (biol\u00f3gicos, qu\u00edmicos ou causados por radia\u00e7\u00f5es ionizantes)\u201d. 3.<\/p>

Como descrito nesta descri\u00e7\u00e3o, a esfera de influencia da OMS n\u00e3o cessou de se ampliar.<\/p>

Hoje, esta prevista a modifica\u00e7\u00e3o as diretivas uma vez mais, limitando ainda mais o direito de
dialogo e de decis\u00e3o dos diferentes Estados permitindo a neutraliza\u00e7\u00e3o das constitui\u00e7\u00f5es ; 4 o
que merece certamente ser mencionado no contexto da reforma constitucional atual.<\/p>

Est\u00e0 assim previsto que na 75\u00aa Assembleia geral da OMS do 22 au 28 maio 2022<\/b> que se
encontrem proposi\u00e7\u00f5es sobre este assunto no texto oficial do 12 de abril de 2022. 6 James
Roguski, procurador e autor na \u00e1rea da sa\u00fade, chama a aten\u00e7\u00e3o para os artigos 12 e 59, que s\u00e3o
essenciais no contexto da autodetermina\u00e7\u00e3o dos Estados. 7 O artigo 12 prev\u00ea um PHERC<\/b>
(Public Health Emergency of regional concern- Urg\u00eancia de sa\u00fade publica a n\u00edvel regional)
(que significa que os burocratas locais ter\u00e3o ainda mais poder) ou a possibilidade do diretos
geral da OMS de declarar uma IPHA <\/b>(intermediate public helath alert \u2013 alerta sanit\u00e1rio
intermedi\u00e1rio). As possibilidades de isolar uma regi\u00e3o do resto do mundo e de privar assim a
comunidade da suas liberdades, na base de decis\u00f5es arbitrarias baseadas no medo, ser\u00e3o assim
alargadas.<\/p>

Paralelamente, a OMS creou um grupo de trabalho para elaborar um novo tratado sobre as
pandemias<\/b>. Este devera entrar em vigor en 2024. 8<\/p>

N\u00f2s desejamos exprimir a nossa preocupa\u00e7\u00e3o em rela\u00e7\u00e3o a esta evolu\u00e7\u00e3o de quase governan\u00e7a
mundial por parte da OMS. 9 Os medos s\u00e3o partilhados no mundo inteiro e justificados. 10<\/p>

At\u00e9 ao dia de hoje, a OMS utilizou a PHEIC (Public Health Emergency of International Concern
\u2013 Urg\u00eancia de sa\u00fade publica internacional) para declarar as suas pandemias. Tal como se passou
para a \u201cpandemia Corona\u201d no 30 de janeiro de 2020, que conduziu o governo luxemburgu\u00eas a
declarar estado de emerg\u00eancia a 18 de mar\u00e7o de 2020 e a impor de seguida uma s\u00e9rie de medidas
com as leis Covid-19 a partir do 17 de julho de 2020, com graves consequ\u00eancias para a sa\u00fade
f\u00edsica e psicol\u00f3gica, a economia e a vida social; sem verificar ele mesmo se este estado de
emerg\u00eancia da parte da OMS estaria comprovado por feitos cient\u00edficos. Uma analise s\u00e9ria
deveria ao menos ter sido feito posteriormente. Por exemplo, existe uma dita PHEIC da parte
da OMS por causa do \u201cv\u00edrus Ebola\u201d 11 , mas isto n\u00e3o gerou impacto sobre a politica de sa\u00fade
do Luxemburgo na \u00e9poca nem atualmente.<\/p>

Alem de James Roguski, dois outros especialistas da OMS manifestaram-se de forma critica
sobre a organiza\u00e7\u00e3o e seguem o desenvolvimento atual: a cientista e procuradora no ramo da
sa\u00fade Astrid Stuckelberger12 e a jurista Silvia Begrendt. Esta ultima sublinhou ultimamente as
ambiguidades jur\u00eddicas sobre a natureza contradit\u00f3ria do RSI em virtude do direito
internacional. 13 Ela creou a sua pr\u00f3pria plataforma sobre estas perguntas.<\/p>

Segunda uma lei de 2015, a \u201c Divisao da inspe\u00e7\u00e3o sanit\u00e1ria\u201d esta encarregada do Luxemburgo.

Somos de opini\u00e3o que o Luxemburgo deveria reconsiderar a sua ades\u00e3o \u00e0 OMS, porque
mina fortemente os interesses dos luxemburgueses (como de todos os outros estados
membros), para n\u00e3o mencionar os elevados pagamentos anuais \u00e0 OMS.<\/p>

N\u00e3o faltam cr\u00edticas <\/b>\u00e0 OMS:
\u2013 nenhuma institui\u00e7\u00e3o democraticamente legitimada
\u2013 sem neutralidade
– conflitos de interesse ; aproximadamente 80% financiados pelo setor privado e farmac\u00eautico.
\u2013 diretor Tedros Gebreyesus, cuja reputa\u00e7\u00e3o \u00e9 manchada pelas graves acusa\u00e7\u00f5es
contra ele como ex-ministro da sa\u00fade na Eti\u00f3pia e suas rela\u00e7\u00f5es com o
Frente de Liberta\u00e7\u00e3o Tigray (TPLF) – sem verifica\u00e7\u00e3o independente
\u2013 vis\u00e3o unilateral da doen\u00e7a com \u00eanfase na vacina\u00e7\u00e3o
\u2013 alarmismo exagerado (exemplo: a chamada gripe su\u00edna em 2009)
\u2013 uma \u201cci\u00eancia\u201d baseada no consenso
Com esfor\u00e7os para consolidar ainda mais poder em suas m\u00e3os, uma evolu\u00e7\u00e3o
perigosos em termos de perda das liberdades das pessoas.
Reconhecemos o objetivo da coopera\u00e7\u00e3o internacional em sa\u00fade, mas
sempre em considera\u00e7\u00e3o e respeito pelas constitui\u00e7\u00f5es e leis nacionais, que
obviamente estaria em jogo se a OMS assumisse.<\/p>
